[Annotation4(Revised)] The Internet Carnival

                                                              The Internet Carnival
     Human flesh search is a collective behavior. Netizens look for evidence with every kind of network tools like online platforms which contain the personal information. This collective behavior takes action first and then organize it themselves. With the changing of the subject, the group automatically assembles and takes action respectively. There is no specific leader. Everyone can do what he want to do. Human flesh is a self-organization.(Yuan & Chen, 2013

Human flesh search provides a stage for the common people to voice for their ideas. It is like a carnival on the internet. In Mikhail Bakhtin’s The Carnivalesque, everyone can join the carnival which has no boundary and anyone whether his social status is high or low can play a part in. (Pan, 2007) Carnival is not an official activity. It stands for the civil. In the carnival, the differences between status, property, family background and age do not exist. People share everything with each other.

Human flesh search is conducted by a group of netizens. There is the roles task-functions (角色分工) (Yuan & Chen, 2013:

1. Mobilize: The one decides the target and others who have something to do
with the target.
2. Information-seeking: People asks the question or look for the resource.
3. Elaborating: People analyze the evidence.
4. Testing: People examine the evidence they found.
5. Free rider: People do nothing and just wait for the outcome.
6. Dissident: People do not agree with human flesh search and ask others to follow the legal official procedure.
7. Distracter: People provide the information which has nothing to do with the discussion.
8. Information broker: People bring the information in or out. They transmit the message.

        People are both performers and audience in the carnival. In the past, the judiciary plays the role of cracking down the crime and represents the justice. By human flesh search, the common people can also investigate the illegal things.

                                               Everyone Can be a Citizen Journalist

    When you hear human flesh search, because of the term ”flesh”, you probably have a bloody imagination that a lot of netizens find out every piece of information of the target which is like a rotten corpse devoured completely by a group of hungry condors. Netizens collect all the information and arrange them in their words even attached with some pictures. They are not professional reporters but they can make their arranged articles look like a piece of News. Also they can publish a series of reports on the Internet. The amateur reports are Citizen Journalist (公民記者). They choose what they observe in their daily life to report.
    With the progress of the technology, for example, the invention of televisions and radio, information can be transmitted more quickly and extensively. However, what kind of information we accept is controlled by the mass media. Not everyone have the chance to convey his idea in a TV program.
Nowadays, more and more people have blogs where they can easily share their thoughts.The professor of law, Glenn Reynolds, who is famous for his blog, instapubdit, argued that "power once concentrated in the hands of a professional few has been redistributed into the hands of the amateur many" (Russell, 2007, p67). Bloggers, the amateur reporters, show what they found on the Internet such as something illegal or immoral. In their blog, they can keep update the content, while the traditional media has to check it again before publishing.
   Columbia Journalism Review ( Samantha Henig, 2005) declares: "We've seen blogs act as media or political watchdogs, but not as aggressive watchdogs of individual violations of social norms. So this seems like a notable step. And, as with the emergence of citizen-journalism, it is an undefined and unregulated step in a cyber world that lacks boundaries and standards."

    Unavoidably, there may be some mistakes in the professional or amateur reports. It is easier and quicker to correct the latter. The person involved can also clean up the misunderstanding in the comments of the amateur reports. Human flash search should not be considered as a cold-blooded hunting. It is an online platform providing everyone a chance to convey his ideas and can be examined and discussed publicly.
Most people consider human flesh search as a terrible monster that fiercely exposed their privacy. But did you ever think about that how much information you put on the Internet by yourself? More and more people use community website (社群網站) such as Facebook. On Facebook, people can list their family member or partner. People share their lives on Facebook with photos, or even show the location. Do you really know each one in the friend list? It is not fair to say that human flesh search invades the privacy. You ,your friends or your friends’ friends are those who also have the responsibility of protecting the privacy

    If someone has done something bad before, it is easy to find his behavior on the Internet. He may have the infamous reputation forever. So do we need to prohibit human flesh search to protect this kind of person’s privacy?  Daniel J. Solove argued that keeping the information confidential too much is dangerous. He stated that If we protect the secrets (the infamous behavior) ,we prevent the spread of right information and also remove the information that help people to evaluate someone.

And I think it cannot be justified.

My points are that,
In order to maintain human dignity and the free development of respect for human, freedom and democracy are core values of the constitutional order. Privacy rights enumerated in the Constitution, though not explicitly, but based on human dignity and integrity of the maintenance of individual subjectivity and personality development, and for the protection of personal life private areas from harassment of others and self-control of personal information, privacy is considered to be the basic rights not cannot be lack of. The problem is that human rights of privacy often has conflicts with human flesh search. In addition to the fact that human flesh search invades people's privacy, the long-term harm that has brought to them may not balance with the degree of punishment, violating the principle of ''crime and punishment balance (罪刑相當原則) '', but may also be in violation of "presumption of innocence (無罪推定原則)" and "due process(正當法律程序)" So it should be properly regulated and give relief to the victims of the pipe. Even the victims petition of relief, it is also time-consuming and money is significant, also the profit of winning the petition is often less than the original plan in mind, so relief is the last of the petition means.''

So, We should not prohibit hate speech, because it was not the best response to the person holding the mentality of hatred.

Uh… all these media help us transmit the information quickly an extensively. However, what we… the information we accept is controlled by these mass media. Everyone can use blogs to tell, to write the articles on the Internet. And people all over the world can see his article. They incitied a food safety scare with an unproven report claiming several popular milk products contained banned [drugs]. And this is a vet’s 獸醫 blog. He wrote an article on his blog to refute the Buiness Weekly’s report. And he… he… It looks like a real… news! And he have many evidence he collected on the Internet or his experience And It looks more persuasive than the Business Weekly And human flesh search is a tool to collect these evidence. …Another example…uh…楊達才 is a Chinese uh….uh….venal official. And his bad behavior is exposed in public with human flesh search. You can see the netizens… This is Weibo um…it is a blog. The netizens collect all… all of his pictures to find out he has many many expensive watches. There is other netizens. They provide other pictures. You can see the watches. His watches are very very expensive. It is…it is the power of human flesh search. I think everybody first heard “human flesh search” has the bloody imagination that it [is] like the… a group of hungry condors eaten by… eat the corpse, the target of human flesh search. I think it is not true. You can see how human flesh search help us to find out the… uh… truth. Human flesh search is not used to invade one’s privacy. Tony: Our topic is ’’ Does Human Flesh Search Stands in Justice?’’ I am against it.       

Alison: What is human fresh search? It is not a official search engine like Yahoo or Google. It is a term created by the Chinese netizens. It’s called 人肉搜索 in Chinese.
It’s the collaboration of netizens. Uh…it means everyone shares the…uh…some informations on the Internet. So we can have the… We can have more precise information details efficiently and… and know more… (I don’t know what I was saying) Most important of all, I believed that it can stand in justice. Because…uh…on the Internet, it is anonymous and some people may think…oh…Hiding behind the computer, no one will know your real identity. So you can do anything you want even the illegal things on the Internet Uh…uh… In 2006, there is a video spread quickly on the Internet. Uh…a poor kitten was stepped on…uh… by a woman wearing high heels. Uh… I have saw the video. It’s very terrible. The kitten’s head was KER-S (a sound) by the high heels. And…ok…the Chinese netizens found out the video was shot in 黑龍江 by the background of the video. And they also find the cat-killer. She is a nurse and she is immediately fired. And I think thanks to human flesh search engine. It is a good tool to crack down the crime and…also show us that the justice can be done by group power. Uh… not the …. Other country also noticed the phenomenon in Chinese. Los…Los Angeles Times said China's 'human flesh search' has uh…eclipsed the International Criminal Police Organization So I think human flesh search engine is a good tool to stand in justice.
